Certificate of Conformity Resolved

Post by swoakes » Wed Sep 26, 2018 5:38 pm

I have been asked by the DVLA to provide a Certificate of Conformity for a vehicle I have purchased (BMW Mini).

The car was imported (in 2008) but I believe incorrectly registered as new when it was imported rather than as a used vehicle built Sept 2006.

Does anyone know where I can get a certificate for a BMW Mini built in 2006 :?: Dealer may be able to help or can I download from somewhere :?:

Dealer should know where to get one from if he cannot produce one himself.

I rang BMW UK customer services. They gave me an email address of a BMW department that should be able to help. I've just emailed them.

Next point of call will be the local dealer who were very helpful in providing the cars service history proving that it was first seen under warranty in Cyprus

Seems odd they want one as it was registered first in another EU country and also registered here (so seemingly not a problem 10 years ago). Why on earth would DVLA want a C of C - should only apply to vehicles not originally sold in the UK, IIRC?

Is this all because you want them to change the date of registration?

Hang on haven't all BMW Minis been built in Swindon? I had to drive past it when Asda sent me to help out from Gloucester over 10 years ago, and that place was huge and used to have signs saying it was being made there like right now, incase the other signs were not obvious enough

I don't want them to change it but given the cars history I expect them to want me to yep

Seems even fishier than a bucket of halibut, this car. I take it the AA have been as much use as a chocolate teapot in all this.

AA told me that whilst they agreed with me that the dealer had mis sold the car they were not "a legal entity" cannot force the dealer to offer a refund.

I advised them that the dealer was not worthy of the AA brand and that they should investigate.

Just checked and they are still an approved AA used dealer

That's something I may do but I plan to take the dealer through the claims online system if/ when the dvla give it a 56 plate whereupon I will be able to quantify a loss in monetary terms

I don´t know but is it not the old saying buyer be ware, and do your homework first as what looks to be a bargain is not or is it trust a dealer to be honest.

I would trust a car dealer like I would trust a double glassing salesman.

Ian.

Totally agree. A VIN check and an inspection of the service records would have uncovered its Cyprus roots before purchase HOWEVER as a dealer they should have done their due diligence and checked its history before advertising it as a 2008 non import car which it is not. That's what I have an issue with.

Did it have a HPi report with it? I believe there’s some sort of insurance associated with that?

Afraid not.

Consumer rights Act is the bit of law I will be quoting.
Goods must "meet any description given to you when you were buying it (whether in the ad or in discussions prior to sale)"
